Terms and conditions of sale
1. Purpose and scope
These General Terms and Conditions of Sale (GTC) define the rights and obligations of Pomone Collection SRL and its customers (individuals and professionals) in connection with the sale of its products. They apply to all sales made by Pomone Collection SRL, whether in-store, online, or by any other means of distance selling.
In accordance with the Belgian Economic Law Code, Pomone Collection SRL provides its customers with the following information prior to any order:

2. Products and Orders
2.1 Products : The products offered are those listed on the website or in the commercial documents sent to customers. Each product is carefully described, but slight variations may exist due to the artisanal nature of the products.
2.2 Placing an Order : Orders can be placed in-store, online via our website, by telephone, or by email. All orders imply full and complete acceptance of these T&Cs.
2.3 Order Confirmation : Pomone Collection SRL will confirm receipt of the order by email. The sale will only be considered final after this confirmation has been sent. For B2B customers, a purchase order must be signed and returned before production begins.
2.4 Availability and errors : Pomone Collection SRL cannot be held responsible for the temporary unavailability of the website. In the event of typographical errors or obviously incorrect prices, Pomone Collection SRL reserves the right to cancel any order concerned, even after confirmation.
3. Prices
3.1 Rates : Prices are expressed in euros, including all taxes (VAT included) for private customers, and excluding VAT for professional customers (B2B), unless otherwise stated. Pomone Collection SRL reserves the right to modify its prices at any time. Products are invoiced on the basis of the rates in force at the time of order confirmation.
3.2 Delivery costs : Delivery costs are payable by the customer and will be indicated when the order is confirmed.
4. Payment Terms
4.1 B2C Customers : Payment is made in full at the time of ordering via the methods offered on the website (credit card, bank transfer, etc.). The order is confirmed upon receipt of payment.
4.2 B2B Customers : For business orders:
50% deposit upon acceptance of the order form
Remaining 50% upon receipt of the order
No products will be delivered without receipt of the deposit. Invoices are payable within the specified time limits. In the event of late payment, penalties may be applied in accordance with the legislation in force.
4.3 Payment Security : Pomone Collection SRL guarantees the security of payments made on its website through secure encryption systems.
5. Delivery
5.1 Delivery times : Delivery times are provided for information purposes only and do not constitute a firm commitment. Pomone Collection SRL undertakes to respect the delivery times indicated, except in cases of force majeure or events beyond its control.
5.2 Receipt of Products : The customer is required to check the condition of the products delivered. In the event of damage or non-compliance, the customer must inform Pomone Collection SRL within 48 hours of receipt.
6. Retention of Title
The products remain the property of Pomone Collection SRL until full payment of the price by the customer.
7. Returns and Complaints
7.1 Cancellation : Individuals (B2C) In accordance with Belgian legislation on distance contracts, consumers have a right of cancellation of 14 calendar days from the day after the date of receipt of the products, without having to justify their decision or pay any penalties.
Consumers therefore have 14 calendar days to notify their decision to withdraw from the day after receipt of the goods. They then have 14 days to return the product, at their own expense.
To exercise this right, the customer must notify their decision to withdraw in writing (by email or registered letter) within the specified period.
The customer may also exercise their right of withdrawal before receiving the goods. The return costs are the sole responsibility of the customer.
Products must be returned in their original condition, unused, complete and in their original packaging. The right of withdrawal does not apply to personalised products, custom-made products, or products that have been opened/used after delivery for reasons of hygiene or health protection.
The right of withdrawal provided for distance sales does not apply to purchases made in physical stores or workshops. These sales are considered final once payment has been made, unless otherwise explicitly agreed with the seller.
In the event of a valid withdrawal, Pomone Collection SRL undertakes to refund the amount paid (excluding delivery costs) within 14 days of receiving the returned products or proof of their shipment.

Resellers (B2B) Resellers do not have the right of withdrawal. Any return request must be made in writing and accepted by Pomone Collection SRL.
7.2 Returns : In the event of a non-compliant or damaged product, or a delivery error, the customer must notify Pomone Collection SRL of the problem in writing within 7 calendar days of receipt.
The customer must provide:
a description of the problem,
clear photos of the product and packaging if necessary,
proof of purchase (invoice or confirmation email).
If the return is accepted, Pomone Collection SRL will offer, depending on the case:
an exchange of the product,
a voucher,
or a refund.
Pomone Collection SRL will cover the return costs only in the event of a proven error or defective product.
8. Guarantees
8.1 Legal Guarantee of Conformity : Pomone Collection SRL is liable for any lack of conformity of the products sold in accordance with the legal provisions in force. In the event of a lack of conformity, the customer may choose between repair or replacement of the product, subject to the conditions provided for by law.
8.2 Commercial Warranty : Certain products may be covered by a specific commercial warranty, the terms and conditions of which are specified on the website or in the documents accompanying the products.
9. Responsibilities
Candles must be used in accordance with the safety instructions provided. Pomone Collection SRL declines all responsibility in the event of improper use, in particular in the event of damage resulting from mishandling or inappropriate use.
Pomone Collection SRL cannot be held liable for any indirect or immaterial damage that may arise from the purchase or use of the products. Pomone Collection SRL cannot be held liable in the event of failure to meet delivery deadlines due to force majeure or events beyond its control.
10. Confidentiality and Personal Data
Pomone Collection SRL undertakes to protect its customers' personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian legislation in force.
- Purposes of processing : The personal data collected is used exclusively for order processing, customer relationship management, invoicing, delivery and to improve our services.
- Legal basis : Data processing is necessary for the performance of the contract between Pomone Collection SRL and the customer.
- Retention period : Data is retained for the period necessary to manage the order and comply with legal obligations (e.g. accounting obligations), unless otherwise requested by the customer.
- Customer rights : In accordance with the GDPR, each customer has the right to access, rectify, delete, object to and transfer their data. These rights can be exercised by contacting Pomone Collection SRL at the email address below.

11. Intellectual Property
All visual and textual elements on the website and media of Pomone Collection SRL remain the exclusive property of Pomone Collection SRL. Any unauthorised reproduction or use of these elements is prohibited.
12. Applicable Law and Disputes
These GTC are subject to Belgian law. In the event of a dispute, the customer shall first contact Pomone Collection SRL to find an amicable solution. Failing this, the Belgian courts shall have sole jurisdiction.
